DEPOSIT: $25 CASH deposit on site and credit card for online bidders. Deposit is refundable unless you are the high bidder and don’t pay for your purchases. Credit card charges accepted for up to $1,000 (one thousand dls), balance in cash or wire transfer. 3% Merchant Services Fee added to all credit card purchases. During the auction you are required to maintain at least 20 percent deposit of your bids. Online bidders agree to provide your credit card number to auction personnel during the auction if requested, likewise the credit card you register with will be charged up to $1,000 at the end of the auction and balance due within 24 hours in cash or wire transfer. If card is declined a $25 processing charge will be added to invoice.
All items must be paid for in full before bidder leaves the premises. Nothing may be removed until it is settled for.
SALES TAX. All sales are subject to State Sales Tax Laws. Sales Tax: 7.75% applies to all purchases. For DMV sales, the current tax rate in the county in which the buyer resides will apply. If purchasing for resale, valid CALIFORNIA resale certificate must be shown and resale card must be completed and signed PRIOR TO INVOICING. Out of state buyers will pay sales tax and will be reimbursed upon presentation of signed bill of lading from common carrier showing merchandise was taken out of state.
BUYERS PREMIUM. 15% Buyers Premium - will be added to your bid price. On Bankruptcy Assets only a 10% Buyers Premium will be applied.
NO WARRANTY: All items are sold AS IS WHERE IS, without guarantee of any kind. The descriptions of items are believed to be correct. Nevertheless, neither those descriptions nor any oral statements made by the Owner (or his agents or officers) or the Auctioneers (or his agents or officers) concerning any item shall be construed as a warranty, either expressed or implied, as to the authenticity of, or defect in any lot, and will not be held responsible for advertising discrepancies or inaccuracies. Bidder has the right to examine the merchandise and accept it the way it is. If you are unsure about an item, please do not bid. Some of the items being sold are surplus or store returns. Some might be new in sealed or open packages. Some might not and could be missing components. Most items have not been tested. Please inspect before bidding. It is your (buyer's) responsibility to inspect.
DISPUTES: If a dispute arises between two or more bidders, the Auctioneers reserve the right to reopen the bidding. The Auctioneer and Owner reserve the right to reject any or all bids and to add or delete merchandise until the item is pronounced sold. In the event of non-delivery of purchased items for any reason whatsoever, the Auctioneer's only obligation and liability to the purchaser is to return the monies deposited for such non-delivered items. If any shortage exists on exact counts, claims for this must be noted by purchaser at time of removal. There'll be no adjustments or credits made after items are removed from premises. It is the buyer's responsibility to confirm item quantities before bidding; no adjustment nor credits will be made on shortages when items are sold as lots with estimated counts. Bidder agrees to indemnify and hold TMC Auction, Ltd. harmless from and against any and all claims, damages, liabilities and expenses including reasonable attorney's fees relating to the breach or dispute of this agreement.
REMOVAL - Please DO NOT MOVE any items without supervision from Auction personnel. All items must be paid for in full prior to removal. NO REMOVAL AUCTION DAY. Removal to take place Mon - Wed (Oct 18 - 20) (9:00am to 3:00pm). Purchasers of DMV Titled Vehicles will need to set an appointment for removal as time is needed to complete the necessary paperwork. Items not picked up by due time will be deemed abandoned & your deposit/payment forfeited. Please bring your original paid invoice for pickup. If you're sending someone else to pick up please email their information and your authorization to release the merchandise.
REMOVAL of items is the sole responsibility of buyer. Neither Owner (or his agents or officers) or the Auctioneers (or his agents or officers) are responsible for loss/damage incurred thereto from removal of item(s) from premise nor for loading the item(s) for removal from premise.
PACK AND SHIP. You may pickup on site, forklift available to assist. You are entering into a legal contract to purchase by accepting these terms and there are no contingencies. Forklift is available on site and will assist. Please bring help as well as packing and tying material for your load. As the auction company we do not ship any purchased items and buyers are responsible for the removal of any and all purchases.
INJURY OR PROPERTY DAMAGE. Buyer acknowledges responsibility for any personal injury or property damage caused by Buyer or his agent, and further agrees to hold TMC Auction, its agents, Seller and his agents harmless from any and all damages, claims, liabilities from injuries to persons or property of any type whatsoever caused during the sale or during the removal of items purchased or afterwards, during the use of the purchased items. Buyer should do his/her own independent research prior to purchasing and buyer agrees that buyer is purchasing as is and any repairs/upgrades needed on these products are the sole responsibility of buyer.
RETURNS. No returns will be accepted, no monetary credits will be given and buyer won't contest any credit card charges due to any of the above. Credit card charge will appear on your statement as TMC Auction, Roseville CA. ALL ITEMS ARE SOLD AS IS WHERE IS with no expressed nor implied guarantees of any kind. The Auctioneer reserves the right to take sealed bids/phone bids/internet bids, accept bids in any increment to the best interest of Sellers & to reject the bidding from anyone whose conduct or actions are not in the best interest of Sellers. The Auctioneer and Sellers reserve the right to add or delete merchandise without prior notice. Sellers may bid on their own property. This catalog is prepared as a guide and we do not warrant the accuracy, description, count, etc. of any of the lots specified. Everything is sold AS IS WHERE IS. All sales are FINAL. Please inspect before bidding.
An $85 document processing fee, a $65 smog fee (if applicable) and a $30 DMV electronic filing fee will be charged by the auction company for every DMV purchase, California law does not provide for a "cooling off" or other cancellation period for vehicles. Therefore you cannot later cancel a contract simply because you change your mind, decide the vehicle costs too much, or wish you had acquired another vehicle. TMC Auction offers a 2-day cancellation option that applies only to passenger vehicles purchased for personal or household use. This cancellation option does not apply to motorcycles, off-road vehicles, recreational vehicles, or vehicles sold for business or commercial use, or any vehicle priced at or above $40,000. In order to exercise this option you must inform TMC Auction at the time of purchase on that specific auction day. The amount is non-refundable and the purchaser will also be charged a restocking fee. The vehicle must be returned by 3:00pm not more than 2 days following the date of the purchase contract. The vehicle must also be in the same condition and the mileage must not exceed the permitted (250) miles otherwise the option is void. Additional fees for purchasing this cancellation option will apply.
IF CUSTOMER DEMANDS TITLE ON VEHICLE PURCHASES. THE BUYER WILL BE RESPONSIBLE FOR THE TRANSFER AND ALL REGISTRATION FEES OR PENALTIES DUE INVOLVING TRANSACTION.
